This website is operated by Harms GmbH (FN 529643m), hereinafter referred to as "we", "us" and "INTERSPORT", with registered office in Wildkogelbahnstr. 441, 5741 Neukirchen/ Gr.Ven. In this privacy policy, we, as the controller pursuant to Art. 4 para. 7 GDPR, describe which data we collect when you visit our website and for what purpose we process it.
The protection of your personal data is of particular concern to us. Of course, we strictly adhere to the legal requirements of the Data Protection Act (DSG) and the EU General Data Protection Regulation (GDPR) when collecting and processing your personal data.
In the following, we will inform you in detail about the scope and purpose of our data processing and your rights as a data subject. Therefore, please read our privacy policy carefully before continuing to use our website and, if necessary, giving your consent to data processing.
Please refer to point 12 of this privacy policy for all relevant contact details.
1. Personal data
The use of our website is generally possible without providing personal data. However, the use of individual services may be subject to different regulations, which we will point out to you separately. In particular, if you wish to use our reservation and rental services, it is necessary that you provide us with certain data for this purpose.
Apart from the cookies described in detail below, we only collect and store the data that you yourself provide to us by entering it in our input masks or otherwise actively interacting with our website.
Data is all information relating to an identified or identifiable natural person. This includes, for example, your name, your address, your telephone number or your date of birth, but also the articles and services you have reserved via our booking platform.
2. Use of cookies
a. When using our website for purely informational purposes, i.e. if you do not use any of our services or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server. Therefore, if you wish to visit our website, we collect the data listed below, which is technically necessary for us to display the website to you and to ensure its stability and security on the basis of our legitimate interest pursuant to Art. 6 para. 1 sentence 1 lit. f EU-GDPR:
· IP address
· Date and time of the request
· Time zone difference to Greenwich Mean Time (GMT)
· Content of the request
· Access status / http status code
· Amount of data transferred in each case
· Website from which the request comes
· Browser used
· Operating system and its interface
· Language and version of the browser software
b. In addition to the aforementioned data, cookies are stored on your computer when you use our website; these are small text files that are stored on your hard drive assigned to the browser you are using and through which certain information is transmitted to the entity that sets the cookie (in this case, us). We need these cookies on the one hand to recognize you as a user of the website and on the other hand to be able to track the reservations you have made in the course of using our services via the shopping cart.
Our website uses the following types of cookies, the scope and functionality of which are explained below:
· Transient cookies
Transient cookies are automatically deleted when you close your browser. These include, in particular, session cookies, which store a so-called session ID, which can be used to assign various requests from your browser to the joint session. This allows your computer to be recognized when you return to our website; these session cookies are deleted when you log out or close the browser.
· Persistent cookies
Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. However, you can delete the cookies yourself at any time in your browser settings.
You can change your browser settings so that you reject, for example, the acceptance of third-party cookies or all cookies. In this case, however, we must point out that you may no longer be able to use all the functions of our website.
We also use cookies ourselves to identify you for subsequent visits if you have an account with us - otherwise you will have to log in again each time you visit.
c. We also use so-called local storage functions (also known as "local storage") on our website. Data is stored locally in your browser's cache, which continues to exist and can be read even after the browser is closed - unless you delete the cache or it is session storage.
Third parties cannot access the data stored in local storage. If special plug-ins or tools use the local storage functions, this is described in the respective plug-in or tool.
If you do not want plug-ins or tools to use local storage functions, you can control this in the settings of your respective browser. We would like to point out that this may lead to functional restrictions.
3. Collection and processing of personal data & storage period
To record your reservation, to process your booking in accordance with the contract and to maintain our service, we use the booking system of INTERSPORT AUSTRIA Gesellschaft m.b.H., Flugplatzstraße 10, 4600 Wels ("ISA").
Personal data that we collect via the aforementioned cookies or through your explicit information is used by us for the purposes of maintaining our website services, to enable the reservations you have made within the framework of the ISA reservation tool and subsequently for direct marketing purposes. While the collection of certain data provided by you in the ISA reservation tool is carried out for the purposes of initiating and fulfilling the contract, we process data to maintain our services and for marketing purposes based on our legitimate interest.
With certain tools, it is possible that you provide us with data on your own initiative and give your consent for the intended data processing, but this will be pointed out separately. Furthermore, we use the personal data you provide exclusively within the scope of fulfilling the respective purpose of the processing, for example to send advertising and information material to existing customers in compliance with the Telecommunications Act (TKG).
The purpose of processing your data is therefore, in summary, to operate our website and to provide company-specific information in a targeted manner, including the presentation of our range of goods and services (marketing). Any further use of your data will only take place if you have given your express prior consent. You can revoke your consent at any time with effect for the future - as explained in detail below.
We generally store data that you have provided to us exclusively for customer service or for marketing and information purposes until five years after our last contact. However, if you wish, we will also delete your data before the expiry of this period, provided that there is no legal obstacle to this.
In the event of the initiation or conclusion of a contract, we will process your personal data after complete contract processing until the expiry of the guarantee, warranty, limitation and statutory retention periods applicable to us, and beyond that until the termination of any legal disputes in which the data is required as evidence
